This Legal Notice regulates access and use of the Esencia de Fé website and digital platform. By accessing, browsing or using the platform, you accept all provisions established in this document in their entirety and without reservation. If you do not agree with any of the conditions set forth herein, you must not access or use the service.

2. Nature of the Service

Esencia de Fé is an indexing, classification and organization service for audiovisual content that is publicly referenced on the internet. The platform does not host, store, transmit, distribute or modify multimedia files on its servers.

The function of Esencia de Fé is strictly limited to providing organized links to content that is already publicly available on third-party streaming services. This activity is carried out in accordance with applicable regulations regarding search engines and content aggregators.

3. Intellectual Property

  1. All audiovisual content referenced on the platform is the property of their respective rights holders. Esencia de Fé does not claim nor hold any ownership rights, title or license over any of the referenced materials.
  2. All code, design, structure, databases, algorithms and proprietary elements of the Esencia de Fé platform are protected by intellectual and industrial property laws. Reproduction, distribution, modification, public communication or any other exploitation without prior written authorization from their holders is strictly prohibited.
  3. The trademarks, logos, trade names and distinctive signs appearing on the platform are registered trademarks of Esencia de Fé or their respective owners. No provision of this legal notice shall be interpreted as granting a license, assignment or right of use over them.

4. Disclaimer of Warranties

  1. THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". ESENCIA DE FÉ MAKES NO WARRANTIES, EXPRESS OR IMPLIED, IN RELATION TO THE PLATFORM, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ABSENCE OF ERRORS.
  2. Esencia de Fé does not guarantee continuous, uninterrupted or error-free availability of the platform. The accuracy, completeness, timeliness, reliability or suitability of the referenced content is not guaranteed.

5. Limitation of Liability

  1. IN NO EVENT SHALL ESENCIA DE FÉ BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY NATURE, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR MORAL DAMAGES, ARISING FROM ACCESS, USE OR INABILITY TO USE THE PLATFORM.
  2. Esencia de Fé is not responsible for:
    • The availability, quality, veracity or legality of content hosted on third-party platforms
    • Changes, removal or suspension of content by their original holders or platforms
    • The policies, terms of service, privacy practices or conduct of third-party services
    • Any damage caused to the user as a result of accessing or using linked content
  3. The user assumes full risk arising from the use of the platform and the content referenced therein.

6. Links to Third Party Sites

The platform may contain links to websites, services or platforms operated by third parties. Esencia de Fé exercises no control over such sites, does not approve, recommend or guarantee the quality, veracity or legality of their content.

The inclusion of these links is for informational purposes only and does not imply any relationship, association, sponsorship or endorsement between Esencia de Fé and the owners of such sites.

7. Infringement Notifications

  1. If you are an intellectual property rights holder and believe that any content referenced on the platform infringes your rights, you may send a written notification to [email protected].

  2. Such notification must obligatorily contain the following information:

    • Complete identification of the rights holder
    • Precise and concrete description of the allegedly infringing content
    • Exact location within the platform of the content in question
    • Authentic proof of ownership of the alleged rights
    • Express statement under penalty of perjury that the information provided is accurate and that the use of the content has not been authorized by the rights holder, their representatives or by law.

  3. Esencia de Fé will evaluate received notifications and take appropriate measures in accordance with applicable legislation.

8. Modifications

Esencia de Fé reserves the exclusive right to modify, update, suspend, interrupt or cancel, at any time and without prior notice, any of the provisions established in this Legal Notice, as well as any aspect of the platform. Modifications will enter into force at the time of their publication.

Continued use of the platform after publication of modifications constitutes acceptance thereof by the user.

9. Applicable Law and Jurisdiction

This Legal Notice is governed in all its aspects by applicable law. For the resolution of any dispute that may arise from access or use of the platform, the parties expressly submit to the exclusive jurisdiction of the competent courts and tribunals.
